1. Introduction and Acceptance of Terms
Welcome to the official Substack publication of IslamInSpanish Inc. (”IslamInSpanish,” “we,” “us,” or “our”), a 501(c)(3) certified nonprofit organization headquartered at Centro Islámico, 12703 Brant Rock Drive, Alief, Houston, Texas 77082. These Terms and Conditions (”Terms”) govern your access to and use of our Substack newsletter, publications, exclusive content, community features, and all related services (collectively, the “Service”).
By subscribing to, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any additional guidelines or rules applicable to specific features of the Service. If you do not agree to these Terms, you must not access or use the Service.
We reserve the right to modify these Terms at any time. Material changes will be communicated to subscribers via email or through a notice on our Substack publication. Your continued use of the Service following any such modifications constitutes your acceptance of the revised Terms.
2. About IslamInSpanish
IslamInSpanish was established in 2001 with the mission of making Islam accessible, relatable, and culturally relevant to the Spanish-speaking world. Operating from the first Spanish-speaking Islamic center in the United States, we provide educational resources, media content, and community support to over 1.2 million people monthly worldwide. Our Substack publication extends this mission into the digital sphere, offering a “no-judgment” space for education, spiritual growth, and community engagement.
3. Eligibility and Age Requirements
3.1 General Eligibility
The Service is intended for individuals who are at least thirteen (13) years of age. By accessing or using the Service, you represent and warrant that you are at least 13 years old.
3.2 Children’s Online Privacy Protection Act (COPPA) Compliance
In compliance with the Children’s Online Privacy Protection Act (COPPA), we do not knowingly collect, use, or disclose personal information from children under the age of 13 without verifiable parental consent. If you are a parent or guardian and believe that your child under 13 has provided personal information to us without your consent, please contact us immediately at contact@islaminspanish.org, and we will take steps to remove such information from our systems.
3.3 Parental Consent for Minors
If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
4. Subscription Services
4.1 Free Subscription
Free subscribers receive access to selected newsletter content, community updates, and announcements delivered directly to their email inbox. Free subscriptions do not provide access to exclusive content designated for paid subscribers.
4.2 Paid Subscription
Paid subscribers receive all benefits available to free subscribers, plus access to exclusive content including, but not limited to: premium videos, podcasts, in-depth articles, special topic deep-dives related to Islamic practice, and enhanced community features. Paid subscription fees, billing cycles, and specific benefits will be clearly communicated at the time of subscription and may be modified with reasonable notice.
4.3 Payment Processing
All paid subscriptions and donations are processed through Stripe, Inc. (”Stripe”), a third-party payment processor. By making a payment through the Service, you agree to Stripe’s terms of service and privacy policy. IslamInSpanish does not store your complete payment card information on our servers. You are responsible for ensuring that your payment information is accurate and current.
4.4 Subscription Cancellation and Refunds
You may cancel your paid subscription at any time through your Substack account settings. Upon cancellation, you will continue to have access to paid content until the end of your current billing period. Refunds for paid subscriptions are generally not provided, except as required by applicable law or at our sole discretion. For refund inquiries, please contact us at contact@islaminspanish.org.
5. Donations and Pledges
5.1 Voluntary Contributions
Both free and paid subscribers may make voluntary donations or pledges to support the mission of IslamInSpanish through our Substack platform. All donations are processed securely through Stripe integration.
5.2 Tax-Deductible Contributions
IslamInSpanish Inc. is a 501(c)(3) certified nonprofit organization. Donations may be tax-deductible to the extent permitted by law. IslamInSpanish will provide appropriate documentation for tax purposes upon request. Please consult with your tax advisor regarding the deductibility of your contribution.
5.3 Donation Refunds
Donations are generally non-refundable. If you believe a donation was made in error, please contact us within 30 days at contact@islaminspanish.org to request a review.
6. User Conduct and Community Guidelines
6.1 Community Standards
IslamInSpanish is committed to maintaining a “no-judgment” space that reflects our values of respect, compassion, and constructive dialogue. When participating in comments, community discussions, and Substack chat features, you agree to conduct yourself in a manner consistent with Islamic principles of kindness, respect, and brotherhood/sisterhood.
6.2 Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
(a) Posting content that is hateful, discriminatory, threatening, harassing, defamatory, obscene, or otherwise objectionable;
(b) Engaging in personal attacks, bullying, or intimidation of other community members;
(c) Posting spam, unsolicited advertisements, or promotional content unrelated to the community;
(d) Impersonating any person or entity, or falsely claiming an affiliation with any person or entity;
(e) Sharing another person’s personal information without their explicit consent;
(f) Posting content that infringes upon the intellectual property rights of others;
(g) Attempting to circumvent any security measures or access unauthorized areas of the Service;
(h) Using the Service for any illegal purpose or in violation of any applicable laws or regulations.
6.3 Content Sharing
Subscribers may share our content within and outside the Substack platform in accordance with the following guidelines: (a) Always attribute content to IslamInSpanish and include a link to the original publication when sharing; (b) Do not modify, alter, or misrepresent our content; (c) Sharing is for non-commercial, personal use unless you have received explicit written permission from IslamInSpanish for commercial use.
6.4 Moderation and Enforcement
We reserve the right, but are not obligated, to monitor, edit, or remove any user-generated content that violates these Terms or our community standards. We may, at our sole discretion, suspend or terminate access to the Service for any user who violates these Terms, without prior notice or liability.
7. Intellectual Property Rights
7.1 IslamInSpanish Content
All content published through the Service, including but not limited to newsletters, articles, blog posts, videos, podcasts, audio recordings, images, graphics, logos, trademarks, and all other materials (collectively, “IslamInSpanish Content”), is the exclusive property of IslamInSpanish Inc. or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
7.2 Limited License to Subscribers
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the IslamInSpanish Content solely for your personal, non-commercial use. This license does not include the right to: (a) reproduce, distribute, publicly display, or publicly perform any IslamInSpanish Content except as expressly permitted in Section 6.3; (b) modify, adapt, translate, or create derivative works based on the IslamInSpanish Content; (c) sublicense, sell, rent, lease, or otherwise transfer rights to the IslamInSpanish Content; (d) remove, alter, or obscure any copyright, trademark, or other proprietary notices.
7.3 User-Generated Content
By posting comments, participating in discussions, or submitting any other content through the Service (”User Content”), you grant IslamInSpanish a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the Service and IslamInSpanish’s educational mission. You represent and warrant that you own or have the necessary rights to grant this license and that your User Content does not infringe upon the rights of any third party.
7.4 DMCA and Copyright Infringement
IslamInSpanish respects the intellectual property rights of others. If you believe that your copyrighted work has been copied and is accessible through the Service in a way that constitutes copyright infringement, please notify us at legal@islaminspanish.org with the following information: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the material claimed to be infringing; (c) your contact information; (d) a statement of good faith belief; (e) a statement of accuracy under penalty of perjury; and (f) your physical or electronic signature.
8. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy. The Service is hosted on Substack’s platform; accordingly, your use of the Service is also subject to Substack’s Privacy Policy.
9. Disclaimers
9.1 “As Is” Basis
THE SERVICE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
9.2 Educational and Spiritual Content
The content provided through the Service is intended for educational and spiritual enrichment purposes only. It should not be construed as professional legal, financial, medical, or psychological advice. For matters requiring professional guidance, please consult with qualified professionals in the relevant field.
9.3 Third-Party Links and Services
The Service may contain links to third-party websites or services, including Substack and Stripe. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. Your use of such third-party services is at your own risk and subject to their respective terms and conditions.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ISLAMINSPANISH INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, VOLUNTEERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
11. Indemnification
You agree to defend, indemnify, and hold harmless IslamInSpanish Inc. and its directors, officers, employees, agents, and volunteers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, trademark, property, or privacy right; or (d) any claim that your User Content caused damage to a third party.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions.
12.2 Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If such negotiation is unsuccessful, the dispute shall be submitted to binding arbitration in Harris County, Texas, in accordance with the rules of the American Arbitration Association. Judgment on the arbitration award may be entered in any court having jurisdiction thereof.
12.3 Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the fullest extent permitted by law, (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated or resolved on a class action-Loss basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
13. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Service, constitute the entire agreement between you and IslamInSpanish concerning the Service and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and IslamInSpanish.
14.2 Severability
If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in full force and effect, and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.
14.3 Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and IslamInSpanish’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
14.4 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
14.5 Notices
Any notices or other communications provided by IslamInSpanish under these Terms will be given by posting to the Service or via email to the email address associated with your subscription account. For notices made by email, the date of receipt will be deemed the date on which such notice is transmitted.
